Like most insurance policies, motor vehicle accident (MVA) insurance is something you ahavea, but tend not to investigate until you need it. Policies vary in coverage and amounts paid should an accident occur. Although no policy is complete, anyone injured in a MVA is entitled to certain benefits no matter who was at fault.
Under the Canadian No-fault law, car accident victims are allowed to sue the other party for damages in addition to the insurance settlement. Insurance companies pay benefits out according to the Statutory Accident Benefits Schedule (SABS), but these payments may not be enough to remedy expenses in a fault MVA. In the rare case that neither party has insurance, the Motor Vehicle Accident Claims Fund takes care of the injured party's expenses.
Expenses covered are:
* Loss of Income. If injuries sustained from the accident prevented you from working at your job, the income lost during the recovery period may be reimbursed. Under the Insurance Act, parties are eligible for up to 80% of their net income from accident to trial and up to 100% gross income loss after trial.
* Medical Expenses. Any medical costs incurred. This includes rehabilitation.
* Attendant Care Expenses. After being injured and then released from the hospital, you may require the help of a nurse or other professional. MVA payments cover this.
* Additional Expenses. Expenses relating to the treatment of injuries sustained during an MVA such as travel costs, any prescribed apparatus, and other costs incurred because of the injuries.
Consulting with your lawyer after an accident is the best way to figure out what you are entitled too. The means of tabulating damages can be complicated and an experienced Canadian lawyer will have a good idea of what settlement you deserve. They will guide you on what to do if your insurance company wants a statement or the other party's insurance company wants to talk with you among other issues.
It is best to be proactive about your MVA insurance policy. Before an accident occurs, find a lawyer to discuss what is and is not covered and what coverage would be best for you. A little preparation goes a long way and a simple consultation can help ease the mind over one's safety if an accident ever does occur.

QUESTION:
Motor vehicle insurance for teenager with permit?
My son is signed up to take driver's education next year. He will receive his permit after taking the course. However, he has no desire to drive and does not want to get his driver's license after he takes the course (whether he will still think this way after taking the course is yet to be seen).
My question is do I still have to carry motor vehicle insurance on him if he just has a permit and not a license? We are in Illinois.
Thank You-
ANSWER:
No. With the permit he can't drive alone, and will be covered by the person with him and the insurance on the vehicle. He will not need to be added to your policy until and unless he gets his license and can drive alone.

QUESTION:
Do you agree or disagree with mandatory motor vehicle insurance?
Just a question I thought I'd throw out there.Explain your position, if you don't mind. Thanks.
-
ANSWER:
I disagree. I should not be compelled to purchase something that I can not afford. My car insurance cost as much as my car. Im serious. Not to mention when I did get into an accident the insurance company was trying not to pay the claim. I had to call several times essentially begging these fukkers to pay for some shit that I already paid for through the premiums.

QUESTION:
how does one cancel a current motor vehicle insurance? ?
since it appears that client is disappointed with standard insurance, is it ok to cancel ongoing car insurance? how? how about switching to another insurance company? is this possible? can i ask for refund from standard insurance? can i recover all that I had paid for the year?-
ANSWER:
Cancellation procedures vary by state. You'll need to call your agent, to see how it works in your state. Most states, if you cancel the insurance without replacing it first, it can get your tags cancelled as well.
Sure you can ask for a refund. How much you get back, will depend on how much you paid in, and how long you've had the policy. If you've had the policy six months, but you paid for 12 months, you can likely get five months back, but that also varies by state.
You won't get back money for time you've already used up, and you'll likely get charged a cancellation fee. Again, your agent can tell you how it works in your state.

QUESTION:
My Massachusetts motor vehicle insurance carrier is terrorizing me, please help.?
I was involved in a rear-end motor vehicle accident in Massachsuestts one month ago. The person who crashed into me from behind is from Massachusetts and owns the car that rear-ended my car. Both cars had insurance. The defendant's insurance company has already accepted 100% liability for the accident. The problem, however, is my own insurance company is investigating my claim! I did nothing wrong. My own insurance company recently had me undergo an examination under oath in the office of the law firm that they use to represent them. 'During the examination, the attorney showed my a copy of my criminal record (which had nothing to do with my accident). My question is-----isn't a person's criminal record private? How can an insurance company simply get a person's criminal record when (a) it had nothing to do with the accident and (b) no lawsuit has even been filed. Isn't this an invasion of my privacy since i never consented to them having it, yet, they got a copy of it. Please help
-
ANSWER:
Nothing is private from insurance companies, especially in MA, I as any insurance agent can find out everything about you from the state run registry, which is why I had the FBI and every police agency in every state I sold for check into my background. Having a criminal record can actually disqualify you from having insurance in most states depending on what it was for, good luck

Motor vehicle insurance claim under indian law?
My friend recently i.e., about 3 months, bought a TATA Indica 2005 model car second hand. He got the registration transfered into his his name but did not intimate the change of ownership to the Insurance company. Today the car that was kept under thached shed reduced to metal skeleton due to fire accident. My question is since the insurance policy as on today is still standing in the name of previous owner... will non-intimation of change of ownership affect my friends chance of claiming insurance? are there any decided case laws on this aspect? Pls. Help with advices.
hi dear Mr. unknown what you say is true only in case of third party liability not to own damages - in my friends case the company refused to cover damages for the non-compliance of intimation of change of ownership.-

whoever holds the title of the car is the owner of the car. The insurance should be changed to the owner's name. Once a car is sold to another person insurance under the previous owner stops (even if they never tell their insurance company).

QUESTION:
Insurance companies by default report to DMV and it goes to your motor vehicle report?
If you have a minor at fault accident and it was not reported to police in such cases insurance companies always report to DMV and it goes to your motor vehicle report and can it affect getting a job or promotion?-
ANSWER:
No.
Insurance companies report to a database shared by them. They do not report to law enforcement.
Your DMV driving record and your CLUE report (this is the insurance database) are separate.
I would be pretty shocked if your employer were to check CLUE, and even more so if they were to hold a minor at fault accident against you.

QUESTION:
Motor vehicle claim insurance-ontario?
I was in a car accident 1 year ago. I was tboned making a left and was 50% at fault.
After the accident I was in a lot of pain,
lower and mid spin and neck and shoulders. I went to my family dr who refused to see me as he did not deal with motor vehicle accident patience. I went to a pain clinic and began treatment with a physio and chiro as well as massage therapy and some acupuncture. None of the treatments seemed to be working. My adjuster was a real b*tch and was denying a lot of therapy and sending me to many different dr. I have a lawyer who deals with my adjuster regularly. Insurance was covering child care and housekeeping and adendant care costs as well as treatment. My adjuster started sending me to her drs. I saw an ortho surgeon of hers and he recommended an MRI in October. My adjuster did not read the report until June and only sent me for MRI in June. She sent me for another assessment with a different ortho in march before the MRI and he denied that there was anything wrong with me and requested my benefits be cut off. The MRI results came in the end of June showing 2 herniated discs causing inpingement. I got a new family dr who percribed gabapentin and I have since seen a neuro who reccomends and emg internal nerve testing. He thinks I have nerve damage causing radiating pain.
I feel due to the lack of work my adjuster has done I have suffered a lot more. If I had an MRI back in Oct I could have prevented further nerve damage. And the ortho back in march decided I didn't have anything wrong with me. Are these cases to sue both adjuster and doctor?? Would I win if I did? What kind of settlements am I entitled to?-

QUESTION:
What insurance must you have on a motor vehicle with 4 or more wheels??
ONE MORE QUESTION.... if your driver license is revoked for DUI or suspended for too many points what type of insurance must you either purchase or prove that you had on the date of the violation??-
ANSWER:
Question 1...
If you don't plan on using the vehicle for commercial use, regular insurance will cover you. If you are running it for profit, there are companies just for that purpose.Question 2...
I am not fully understanding the question. Firstly, you need your SR-22 (Suspended/Revoked Driver License), then you need to find an insurance that will insure you, and then stay clean for a LONG while...
If you had insurance on the date of the violation, ask your insurance company to send you a copy of "Proof of Coverage" to take with you to court. If you have already been convicted, you're just about out of luck...you may want to talk to an attorney.

QUESTION:
Is it true if i cancel my insurance without returning the plates, motor vehicle will find me .00 a day?
Thats what my insurance company said.....I live in new jersey..USA-
ANSWER:
Not too sure about NJ, but years ago in MO I had to cancel my insurance to help pay other bills. When I eventually started insurance again, I just switched companies and told the new company I was sick and tired of crappy customer service from the other guy. They asked no questions, I paid no "uninsured" penalties.
It may be different nowadays though, because even though I had an expired proof of insurance paper in the glove box, during a traffic stop the police officer was able to view on his in car computer that my insurance had not actually expired or had been cancelled. Maybe your state is different?

QUESTION:
How do I renew my proof of vehicle insurance if it is under my mother's name?
I'm 19 and my mother pays for my insurance. I need to get new proof of insurance for my car and it's past the expiration date for my auto insurance card. I need to do this on my own for complicated reasons and within the next three weeks before my court date. Are there fees involved? Do I need to go to the motor vehicle department? What do I need to bring with me? I'm freaking out right now and need to know EXACTLY what to do if anyone can help! Thx!-
ANSWER:
If mom hasn't paid the renewal premium, you can always send a check for it or reinstatement; just ask mom for the bill or call her agent/company. When you get the new/renewal policy, you'll get a new ID card; take that on the court date and you should be OK. If there was a lapse, though, you might still get a fine.

QUESTION:
Why does CAR INSURANCE cost more when a CAR/ motor vehicle is PAINTED RED?
Why does the color red coast more to insure ?-
ANSWER:
Because it is scientifically proven that seeing the color red increases your heart rate and metabolism. So cops will be more likely to pull over a red car going 10 over than a blue car or yellow car. Same reason why all the fast food places are the color red. Increasing your metabolism helps you digest and makes you more hungry than you'd normally be, helping the company sell more of its product to you.

QUESTION:
I'm suing an insurance company for a motor vehicle accident?
I'm 16 and my mom wanted to sue, They are going to offer around 75 - 100 thousand. I was told that if your 16 you can get the money, but I don't know if that's true.So my question is, Is it true or false?
-
ANSWER:
You are not suing the insurance company..you are suing the person that hit you..that person is covered by insurance. The judge will probably demand that the money be placed in a trust. However, if you have not sued yet you are not guaranteed anything. You can only hope that you are offered a settlement. BTW jurys are getting tired of these accident payouts..so you had better hope they want to settle and not drag you through a trial. Because winning is not guaranteed.

The only state that doesn't require that is New Hampshire. Otherwise, state law and common sense require it. QUESTION:
does standard insurance have the capacity to serve its motor vehicle policyholders?-
ANSWER:
Capacity refers to the ability of a company to pay claims. Obtain the financial statement of the company and you look for the written premium to surplus ratio. Surplus refers to the amount of money available to pay claims. Written premium refers to the amount of business they write with the agents. So, if the company writes more than is available to pay claims, this is considered a bad thing.

QUESTION:
If my teenager gets his first drivers license will my auto insurance find out from the Motor Vehicle Dept?-
ANSWER:
Only if you had to file a SR22. If the teenager is going to operate the vehicle, I would strongly suggest you add him/her to your insurance policy, which will probably increase in premium rates.
Keep in mind, if the teenager drives your vehicle and gets a ticket, or in a collision, your insurance carrier may revoke coverage alltogether leaving you with a hefty bill to cover.

QUESTION:
Live in Massachusett. Had motor vehicle accident. My own insurance company said I was at fault.?
Then they notified me that I was being surcharged and would have point added to my insurance step rating. I appealed. At the appeals board hearing, i was found not to have been more than 50% at fault. My insurance company reversed the surchargable points they had initially assessed against me, however, they refuse to refund me my 0 deductible, claiming they only have to reverse the surchargable points. I cannot get the claims adjuster to refund my 0 deductible. What should I do? Any laws or statutes I can reference?-
ANSWER:
They don't have to refund your deductible, that is the portion you are responsible for. You agreed to that when you purchased your insurance policy - it is a deductible in which you chose. The only option you have, is to pursue the at fault party for your deductible. The only way your insurance company could in any way reimburse you the deductible is if they were able to recover it from the adverse carrier - when they send the file over for subrogatioln. Otherwise, if they recovered nothing from the adverse carrier they are not legally obliged to reimburse your deductible.Follow up with the adverse carrier - it will be your best shot. (and you may only be able to recover the % at fault you were not - eg. if you were only 25% at fault, you would only be entitled to 75% of your deductible.)

QUESTION:
I live in Massachusetts. Was in a single car motor vehicle accident in Rhode Island. I was a passenger.?
The accident happened about one month ago. Got seriously hurt. The owner of the vehicle I was in lives in Rhode Island, where the car is also Registered and Insured. The insurance policy is a bare minimum policy. I have no household automobile insurance policies and do not own a car. I live in an apartment. I am not on anybody's insurance policy. My question is, "If it becomes necessary, can I file suit against the driver of the motor vehicle and his insurance carrier in Massachusetts.......or must I file suit in Rhode Island where the accident happened, where the defendant lives, and where the defendant's motor vehicle is registered and insured. Please refer me to any Massachusetts and/or Rhode Island statutes that might be helpful. Thank you.-
ANSWER:
You can sue the driver's insurance company and be paid in full usually without having to go to court. I believe it's 20 or 40K per passenger for minimum coverage. The lawsuit would take place in RI because that's where the driver is insured. It doesn't matter where you live or if you're insured.

QUESTION:
Another question about my insurance claim from a Motor Vehicle Accident...?
Ok so I have asked another question about the same topic which resulted in me not going to get a lawyer for my accident i'm just going to let my insurance handle it.Here's the accident to refresh your memory, I was driving down a road and an old lady was making a left turn off a side straight and instead of going ahead and gunning it to turn she just braked so we hit (front of my car hit side front of her car) she's def. at fault. And her insurance company has already had my car fixed.
Now one more question.. My dr's have found that I have a torn rotator cuff .. so whats next is to schedule surgery to repair that then physical therapy.. Her insurance company contacted me today to let me know that when i'm treated from the injury then they will give me my claim... How much should I be expecting - the adjuster said today they will take into consideration pain and suffering, medical bills, and missed work but i'm unemployed - so how will that work? I'm just wanting to know what to expect when the insurance person calls me and gives me an offer.. any idea?

ANSWER:
There's no way to know. It's going to depend heavily on what state you are in, and her policy limits - plus, how much the surgery and physical thearpy cost.
