Receiving a DUI (driving under the influence), an underage DUI, or evading the police in California will result in a driver's license suspension. Before the California DMV will reinstate your license you will be required to provide them with what is known as proof of financial responsibility in the form of an SR22 filing.

In addition, if someone is in an accident and does not report the accident within 10 days, their license will be suspended for up to four years. A person can get their license back during the last three of these years if they carry SR22 coverage. A person is required by California law to have auto insurance and this includes if the person is driving on a restricted license.

When a license is confiscated by a California police officer the driver will receive a aNotice of Suspensiona which acts as their temporary driver's license for the next 30 days. The person with the suspended license then has 10 days from the time that the officer issued them the aNotice of Suspensiona to request an administrative hearing with the DMV so they can try to prove the charges against them are unjust and hopefully avoid a license suspension.

      What state? How long did you have insurance with that agent? Was the agent suppose to file the SR-22 or the company?

      To know if his license is suspended or not you have to call DMV. No one here has access to his DMV record. After the SR-22 is filed he can go get his license back. Sometimes SR-22 are needed because you did not fill out the DMV form (in California it is an SR-1 form) within the 10 days the DMV requires. It has nothing to do with who was at fault.

      Bottom line is your boyfriend has to call the DMV to see if his license is suspended and to see if the SR-22 is in their computer system. By the way, the insurance company sends the SR-22 to the DMV computer. So, you do not need to get one from the agent or company.

      If you live with your parents, they have to call their insurance company and add you as a driver & add the SR22. This will cause their insurance to go way up (if their company even keeps them since you would have had to have had a major violation to need an SR22). If they are already with a company like Progressive, they will not be cancelled.
      If you live alone or with someone that does NOT own a vehicle, then you can purchase a nonowners policy and have the SR22 added. A nonowners policy is usually just as expensive as if you had a car with liability only coverage.
      For clarification, an SR22 is NOT insurance. It is a certificate attached to an auto insurance policy that is issued to the requesting state to show proof that you have insurance. If the insurance is cancelled, the insurance company will issue an SR26 showing the state the cancelled policy.
      You can buy/own a vehicle without a license. I insure someone who bought her vehicle before she got her license, she just put her parents as drivers on the policy. I also insure many elderly people who still own cars but gave up their licenses, they just add their children as drivers as they are the ones that drive them around.

      No, it won't extend the three year period you will have to report on SR22 form, but it will add more points to your license and perhaps drive your insurance rates even higher.

You can always look at your own record, and the DMV may have it listed there, so take a look. If not, contact the court and ask. Also, if you were represented by attorney, he might have that information.

      Try Progressive.com or 1800Progressive. They are there 24 hrs. Also, just so you are aware, you can get the nonowners policy ONLY if there is NO car in your household & NO car available for your regular use. If you buy the policy & then have a car available for your regular use (borrowing it for a while), the policy will NOT pay. Also, renting a car will be VERY expensive since there is no comprehensive & collision on a nonowner policy, it is liability only, there would be NO coverages for damage to the car (you would need to buy the LDW from the rental car co) - then it is debatable whether the liability will be valid (if you were renting long-term) because it could be considered available for your regular use.
      The best thing to do is to buy an old car you can get liability only on - get a regular auto policy & add the SR22 to that policy. It is usually cheaper than a nonowner policy too.

      Insurance companies have the ability to check:

      1. Your Motor Vehicle Report (MVR) which shows any tickets, license suspensions, DUIs, or any infraction that would be registered with the state.
      2. Your claims history report called a CLUE report. A CLUE report will show any time within the last 5 - 7 years that you made a claim on your insurance.
      3. The registered owner of any vehicle on your policy. (This is usually checked when you file a claim.)

      Be honest on your application though. If an insurance company can prove that you made a material misrepresentation on your application, they can void coverage. Some insurance companies will look for anything they can to deny a claim.

      EXAMPLE: I had a client come to me from another agent. This client filed a claim on his insurance because his friend from college, who was living with him at the time, drove his car and got in an accident. My client answered there were no other household drivers on his application when in fact his buddy was a household driver. The insurance company looked at his application and got my client to withdraw the claim. We eventually got the insurance company to cover the claim, but it was a headache none the less.

      Bottom line, be as honest as you can. I don't recommend putting yourself in a position for an insurance company to have grounds for denying your claim because they suspect you lied on an application. It's not worth it.

      Well, it depends on the violation, the state, and the coverages he has.

      He should expect a 50% surcharge on his auto insurance, for that SR22. He should also expect that with three years suspended, and a DUI, his insurance is going to cost a way, way WAY lot more than it did back then.

      Other issues that factor in, are his credit score, driving record, vehicle type, age, and which coverages and how much he has.

      Normally the DMV mails the SR-22 Filing back to the insurance company. However, I would go to the DMV at the end of next month and inquire if you still have to have the SR-22 on file and if they say you do ask them for the exact date until when you have to have the filing.

      It varies. It's usually a percentage of the basic coverage, it can easily be double. It depends on the violation.

      Usually, though, you can't pay it on a monthly basis, you have to pay it in full for a year. But if his regular policy was costing him 0 a month, sure, it's not a surprise that the SR22 endorsement (after all, it's just an ENDORSEMENT) is costing 0, after the surcharge for the initial violation.

      Let's walk through it.

      To get a social security number, you must be in the country legally. To get an insurance policy, these days, you must have a social security number. An SR-22 is an endorsement to an auto insurance policy.

      If it makes you feel any better, you can't renew your driver's license, when it expires, without proof that you're in the country legally.

      So, if you're here legally, apply for the SSN. If you're not, you're not going to be able to get your license reinstated ANYWAY.

      It's not likely you'll be able to get a nonowners SR22. See, it won't cover you driving any car owned by you or a household member, or regularly available for your use. If you DO have a car you will be driving, you NEED to be added as a driver on that policy. If you don't, you'll have to wait until you have a car you need to be driving.

      The cost can be anywhere from to thousands, depending on the reason your license was suspended, and which coverages are on the car you'll be regularly driving.

      Regarding monthly payments and actual cost, it depends on what the violation was, your entire driving record, and which state you need it for - many states won't give "monthly payments" on an auto policy where an SR22 filing is required.

      A state could require everyone to file an SR22 insurance form. The only reason why they don't is that it would be too cumbersome for most people.

      Because the constitution requires states to give full faith and credit to the judgments of other states, there is nothing unconstitutional about treating a DWI case from another state the same as you treat DWIs from your own state. The only thing that would be constitutionally problematic would be if they treated out-of-state convictions more severely than in-state convictions.

      Your "friend" will not be able to get any cheap insurance due to his license being suspended. Tell him to shop around and take the cheapest rate he can find with an insurance company that is willing to insure a driver that has a suspended license on record.

    In August I was sentenced with an under 21 DUI, and was consequently given 6 months probation and 6 months license suspension as well as a treatment program. I was also given a withheld judgment after successful completion of all my terms of treatment and probation.

    My question is, once the withheld judgment is put in place will I still be required to carry SR22 for the 3 years?

      This not the same for every person. It depends on what the judge decided you punishment should be. I have seen people that are only required to carry the SR222 for 6 months and others who need to carry it for 5 years for the same offense.

      If you did not have insurance at the time, then yes it could be required. There is no way for you to stop that requirement, but the terms should have been given to you at your sentencing in writting and verbally.

      i would ask for quote on car you are thinking about buying. such as a mini van, sedan or a pick up truck. go to progressive.com. they insure high risk drivers like yourself. not to say you are a bad driver, but you are a high risk based on your history.

      If she lives in your household and has access to the vehicle, she needs to be listed on that person's policy as a driver.

      If she reside outside that person's household and she going to drive someone else's vehicle on a frequent basis, that person should list her on that policy as a driver.

      The SR22 is an endorsement on a regular auto policy. It's not a matter of finding a buncha companies happy to write the endorsement - because whatever it was that got you the SR22 is going to make MOST companies not want to write your auto policy.

      So you're going to have to get a "high risk" policy, pay the surcharge for the offense, and also pay the surcharge for the SR22 endorsement. And you MIGHT not be able to get payments on it - you might be required to pay your year in full. You'll likely end up with Infinity Leader, or Progressive - both write it. As far as how much it costs, it's going to depend on the offense. You'll need to bring the letter with you, when you go get your quote, stating that you need the SR22 filing.
